Terms and Conditions
IMPORTANT LEGAL NOTICE
These Terms and Conditions (Terms) govern your access to and use of:
the VocaMinds mobile application and any related digital interfaces (the App);
any journaling, voice recording, transcription, summarisation and self-reflection features made available through the App;
any artificial intelligence-enabled, machine learning-enabled or automated features made available through the App from time to time (AI Features);
any supportive messaging, information and details of third-party support services made available through the App (Support Resources); and
any additional features, content or services made available by or on behalf of VocaMinds from time to time,
(together, the Services).
The Services are provided to you by VocaMinds Pty Ltd (ACN 699 352 960) and our related bodies corporate (VocaMinds, we, us or our).
The Services are made available through the App only. Please read these Terms carefully before using the Services, as your use of any part of the Services is subject to these Terms. If you do not accept these Terms, do not use the Services.
Definitions
In these Terms:
AI Features means any artificial intelligence-enabled, machine learning-enabled or automated features made available through the App from time to time, including the transcription of voice recordings, the summarisation of Journal Entries, and the detection of language patterns that may indicate a User could benefit from Support Resources.
App means the VocaMinds mobile application and any related digital interfaces.
Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended from time to time.
Business Day means a day that is not a Saturday, Sunday or public holiday in Victoria, Australia.
Journal Entry means any entry created by you through the App, whether by voice recording or by typing, together with any transcription or summary of that entry.
Privacy Policy means our privacy policy made available through the App, as updated from time to time.
Related Parties means, in relation to VocaMinds, its directors, officers, employees, contractors, agents, service providers, related bodies corporate and their respective officers and employees.
Support Resources means any supportive messaging, information and contact details for third-party support services (including Australian support hotlines) made available through the App.
User, you or your means the person who accesses or uses the Services.
User Content means all content you upload, create, record, input or submit through your User Account, including Journal Entries and any voice recordings, text, transcriptions and summaries.
Introduction
When does your Agreement start and finish?
By creating a VocaMinds account (User Account), registering for, accessing, or otherwise using any part of the Services, or completing the steps for sign-up, you agree to be bound by:
these Terms;
our Privacy Policy;
any applicable laws and regulations; and
any reasonable direction by us, including those required by law,
(together, your Agreement).
In the event of any inconsistency between any document that is part of your Agreement and another document, these Terms will prevail to the extent of the inconsistency, unless expressly stated otherwise.
Your Agreement commences on the date you first access or use the Services and continues until it is terminated in accordance with these Terms.
Responsibility for use of the Services
You agree that you are responsible for your use of the Services, including for all activity carried out through or in relation to your User Account.
Policies
From time to time, we may publish policies applicable to the Services within the App. You must comply with all policies applicable to the Services.
Use of the Services
Eligibility
Unless we expressly state otherwise, you must be at least 18 years old to create a User Account or use the Services. By creating a User Account or using the Services, you represent and warrant that you are eligible to do so under this clause.
User Account
To access the Services you must create a User Account. When you sign up, a verification code is sent to the email address you provide, and you then create a password and set up your profile. You:
must provide accurate, current and complete information requested by us for account creation and administration;
must maintain the confidentiality of your login details;
must not share, transfer, sell or otherwise provide your login details to any other person;
must immediately notify us of any suspected or actual unauthorised access to your User Account;
are responsible for maintaining and updating the accuracy of the information you provide to us relating to your User Account; and
are responsible for ensuring that any device you use is capable of accessing and using the Services.
User Content
When using your User Account, you may create User Content, including by speaking into your device’s microphone or by typing. You are at all times responsible for all User Content you create, record, input or submit through your User Account, and your User Content must comply with this Agreement and all applicable laws.
Removal of User Content
Your Journal Entries are private to your User Account, and we do not access them except as described in these Terms and our Privacy Policy or as reasonably necessary to provide, secure or improve the Services or to comply with law. We may remove, restrict access to, or decline to store User Content where we reasonably believe it breaches this Agreement or any applicable law, or where we are required to do so by law.
